Indian Worker's Movement Constitution
Preamble
The Indian Worker's Movement(IWM) is a socialist party that accepts people from all nationalities and any gender. We are multicultural but we are united by our willingness to sacrifice, serve, and lead in the interests of the workers both domestically in India and internationally in other countries. We are an internationalist party, the emancipation of the worker is not something to be desired only in India but in every country. We recognize that the emancipation of the workers will be by the workers themselves which means the IWM is not looking to just win Congress elections, the workers movement must change the society itself, this makes the IWM a Revolutionary Party.
Amendments
I. Leadership and Governance.
1. The IWM shall be governed by the Party President and the Politburo.
2.a. The Party President shall be elected through a democratic vote via ERepublik and Party forums to ensure a hostile PTO is not attempted. The Party President is limited to no more than four consecutive terms, but may run again after a single term has passed. A Party President elected that has not been officially nominated by a current member of the IWM will not be recognized as a Party President and will be declared a PTOer. Stipulations outlining the procedure to follow in this event are found below.
b. If their is a PTO of the IWM the Party President elections will be considered null and void, the president elected by the democratic vote through the IWM forums will be considered the true Party President and will be granted the same powers as they would if there was not a PTO.
3. The Politburo will shall consist of the Party President and the director of each Party office: Recruitment, Public relations, Office of elections, Office of the Treasury, and International relations.
4. The directors of Party offices shall be picked by the Party President and confirmed by a majority vote of members.
II. Power granted to the Party President.
1. The Party President shall have executive powers, with the ability to make on the spot decisions.
a. Executive decisions will be defined as making decisions that would usually be up to the director of one of the Party's offices or by democratic vote by the party members. The President will immediately contact the director with jurisdiction, and notify him/her of the decision that he/she made. In the case of a decision under the jurisdiction of the party, the President must immediately inform the party.
b. If the director with jurisdiction over said office, or the party in the case of a decision that falls under member jurisdiction, does not agree with the decision made he/she/they can put the decision to vote in the Politburo, or party forums in the case of party member jurisdiction, and reverse the Presidents decision if they get 1/2 vote in the Politburo, or they can put the decision to vote in a poll-thread in the forum where every member can vote(henceforth known as a "party vote"). If the members of the party vote the decision to be reversed by a 2/3 vote, it shall be reversed.
2. The President shall be responsible for creating organizations and party offices.
a. All appointed Directors must be confirmed by a simple party vote, majority rules.
b. A Party office can be abolished by a simple majority vote in the Politburo or a 2/3 party vote.
3. The Party President shall have the power to nominate official party candidates for Congress based on recommendations or primaries within the party. The Party President shall endorse a President for India based upon a party primary.
III. Powers of Directors and the Politburo
1. Each Director shall have jurisdiction over their respective Party offices but specific plans and orders can be overridden by a simple majority vote in the Politburo or by direct order of the Party President.
a. A direct order by the Party President can be overridden by a simple majority vote in the Politburo.
2. No person shall be Director of more than one office.
3. Each office Director is considered a member of the Politburo.
4. Each Director shall provide the Politburo with briefings concerning their office upon request, completion, or progress of a undertaking of their office.
5. Directors of the Politburo may recruit and direct staff in their respective departments if desired.
IV. Party Offices
1. The Office of Recruitment is in charge of recruiting citizens in India and abroad to become party of the Indian Worker's Movement and to encourage new recruits to be active on the forums.
2. The Office of Public Relations is in charge of writing and editing official newspaper articles for the parties newspaper. This includes, but is not limited to, highlighting our achievements, showing the plight of the workers, party announcements, and assisting the offices of Recruitment with recruiting, and the Office of Elections with campaigning.
3. The Office of Elections is in charge of assisting candidates from the IWM to get Congress seats. This includes campaigning and organizing voters.
4. The Office of International Relations shall be in charge of representing the IWM in foreign governments, parties, or organizations, as well with bringing back topics to discuss from those bodies.
5. The Office of the Treasury shall be in charge of the maintanance and care of the IWM Commune and all IWM monetary assets. The Director of the Treasury will serve as the IWM Commune GM and will run the day to day affairs of the commune. He/she will be responsible for providing bi-weekly financial reports to the Politburo, which must then be made public to the party.
V. Impeachment.
1. Any Politburo member or Party President can be impeached with a party vote of 2/3.
2. The PP and/or a member or members of the Politburo may only be removed from office if they have deliberately ignored any content written in this constitution, have attempted to change the alignment, name, or purpose of the IWM without the consent of the party as a whole (PTOers), have colluded with institutions or parties (groups, individuals) that have the potential to be damaging to the party or the party's interests in India and the world, shown evidence of conspiracy against the IWM, or have stolen party assets. Simple unpopularity is not considered grounds for impeachment and a motion may not be made on these terms.
3. In the scenario of a successful motion for the impeachment of the PP and/or a member or members of the Politburo, meaning after a motion for impeachment has been initiated and 2/3 of the party have voted in favor, a hearing must take place in order to ensure that accusations are infact authentic, and not fabricated, before the accused are removed from office. The following sub-sections outline the protocal for said impeachment hearing.
a. Any accusations that meet the criteria previously specified and justify the removal of the PP and/or a member or members of the Politburo must be successfully proven by the accuser and only the accuser using empircal evidence and/or credible witness testimonial.
b. The case will be heard and decided by a jury of four party members. Two will be selected and voted on by the politburo and the PP, two will be selected and voted on by the party as a whole (excluding the politburo and the PP), and an impartial fifth, who will serve as a moderater/tiebreaker, must be selected and agreed on by all four members of the chosen jury.
c. An impeachment hearing must be adjourned in exactly one week, a jury will always have no more than one week to decide on a verdict no matter the length of the hearing. After a week has passed without adjourning the hearing is automatically adjourned, no more evidence will be heard, and the jury must begin to make a final decision.
d. In the case of indecision (if the moderator is unable to reach a decision in the case of a locked jury after the mandatory time period for deliberation has passed), a majority party vote will be the decider. The time limit for a majority party vote is three days. After three days votes will be tallied no matter the voter turnout. The results will be final.
5. During an impeachment hearing, the accused will still retain the responsibilities and power designated to their office.
6. If the accused are found guilty by the jury or majority vote, all powers granted to them will be immediately null and void. An emergency vote will then be initiated, following the protocal outlined in this constitution concerning the electing of party officials, to establish a replacement or replacements.
VI. Concerning Party Assets
1. The Party Org
a. All members of the Politburo shall have access to the IWM Org, this means they shall have the password.
b. The Password to the Org must be changed after a member has left office, unless that member has simply changed his/her position in the politburo.
bb. Any member that is found guilty, beyond a reasonable doubt, of leaking the password to anyone outside the Politburo will be immediately kicked from office, and the password must be changed. If the offender is the PP, the procedures for government under a PTO PP will be followed.
c. No member may move funds from the party org other than the IWM commune unless first approved through a 2/3 vote amongst the Politburo. These votes will last no more than 48 hours and must be present on the Politburo forum for all to see.
d. No member of the Politburo may change the logo of the IWM without a 2/3 party vote. The ideology or orientation of the IWM may not be changed under any circumstances.
2. The IWM Commune
a. The Commune is ultimately ran by its workers and its workers alone. The GM (Director of Treasury) is responsible for carrying out the will of the workers
b. To expand into other industries the GM must initiate a worker vote. Majority Rules.
c. Any worker in need of goods produced in the commune may request them up to the ammount of room available in the worker's inventory. If available in stock, the goods must be delivered as requested, unless by doing so the GM would be hindering the progress or well being of the commune and/or the request is unreasonable.
d. Any changes in wage must be put to a majority vote.
VII. Party Member Rights
1. The IWM is absolutely ran and directed by its members. All leadership is elected, approved, and therefore held accountable to party members.
2. A member of the IWM has the right to post opinions, concerns and information on the IWM Party Forums. The politburo must take member opinion in to consideration during their tenure in office.
3. All major party decisions must be put to a vote to be approved by the IWM party members before implementation. Such decisions, other than previously outlined in the constitution, include, but are not limited to: The banishment of a member from the party forums (in this case the banished must be found guilty of espionage, sabotage, or conspiracy (PTO) beyond a reasonable doubt if the banished is an IWM party member, if the banished is not a member of the IWM, then banishment can be allowed by a simple majority vote), a party wide PTO attempt on another Indian Political Body, the official party wide endorsement of Indian political figures and procedures (Country Presidents, Congressmen, Political Programs etc…)
Any decisions that are not stated here and are not already outlined and assigned to certain parties in the IWM constitution are considered in the jurisdiction of the party members.
4. IWM members have the right to protest and debate decisions made by the politburo and if necessary, as outlined in the constitution, may initiate impeachment protocols to remove an elected official if their actions meet the requisite for impeachment. In doing so party members must follow the procedure outlined in the constitution of the IWM
5. As long as an IWM member is active and not officially banished from the IWM forums, their right to post on the forums is absolute and may not be censored or inhibited under any circumstances unless previously outlined in the IWM Constitution. However, Forum Moderators may ban members for reasons outlined in the agreement while registering for the IWM forums.
6. A member of the IWM has the right to aspire for political office, be it congress, National President, or Party Office. Primaries must be held in the case of congressional candidates and National Presidential candidates before a party member can be officially endorsed by the IWM when running for these positions. Candidates for Party Office must be nominated or selected and approved by following the procedure as stated in the IWM constitution.
7. Party Members have the right to travel. No member can be denied access to the party forums on account of leaving the party to travel internationally no matter the duration or frequency of travel.
VIII. Ratification and Amendment.
1. The Indian Worker's Movement's Constitution must be ratified by a 2/3 party vote of active members present on the official IWM forums and so must an Amendment.
